Welcome to Linkery! These Terms of Service ("Terms") govern your use of the Linkery mobile application ("App", "Service", or "Linkery") developed by Chainless Technologies ("we", "us", or "Company"). By downloading, installing, or using Linkery, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using Linkery, you confirm that:

• You have read, understood, and agree to these Terms
• You are at least 13 years old (or the minimum age in your jurisdiction)
• You have the legal capacity to enter into this agreement
• Your use complies with all applicable laws and regulations

Linkery is an intelligent link management application that allows you to:

• Automatically extract metadata from saved links
• Use AI-powered analysis to categorize and understand your content
• Sync your data across devices using iCloud
• Search and rediscover your saved content
• Access premium features through Linkery Plus subscription

3. License to Use

Grant of License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Linkery for personal, non-commercial purposes in accordance with these Terms.

License Restrictions

You may not:

• Copy, modify, or distribute the App
• Reverse engineer, decompile, or disassemble the App
• Use the App for any illegal or unauthorized purpose
• Remove or alter any proprietary notices or labels
• Use the App to violate any third-party rights

4. User Accounts and Data

Account Creation

While Linkery can be used without creating an account, certain features may require:

• Apple ID for iCloud sync functionality
• Device identification for subscription management
• Analytics identifiers for app improvement

Your Content

You retain ownership of all links, notes, and content you save in Linkery ("Your Content"). By using the App, you grant us permission to:

• Store and sync Your Content through iCloud (if enabled)
• Process Your Content for AI analysis features (when requested)
• Use anonymized, aggregated data for app improvement

Content Responsibility

You are solely responsible for:

• The accuracy and legality of Your Content
• Ensuring you have rights to save and analyze linked content
• Compliance with website terms of service when saving links
• Not saving illegal, harmful, or infringing content

5. Subscriptions and Payments

Linkery Plus Subscription

Our premium subscription service offers:

• Unlimited AI-powered link analysis
• Advanced categorization features
• Priority customer support
• Early access to new features

Subscription Terms

• Billing: Processed through Apple's App Store
• Auto-Renewal: Subscriptions automatically renew unless cancelled
• Pricing: Current pricing displayed in the App Store
• Changes: We may modify subscription prices with advance notice
• Cancellation: Cancel anytime through iOS Settings > Subscriptions

Free Trial

• New subscribers may receive a free trial period
• You will be charged when the trial expires unless cancelled
• Trial lengths and availability may vary
• Only one free trial per Apple ID

Refunds

Refund requests are handled according to Apple's App Store refund policy. We do not process refunds directly.

6. AI Analysis Features

Powered by OpenAI

Our AI analysis features use OpenAI's technology to:

• Categorize your saved links automatically
• Extract key information and summaries
• Provide intelligent organization of your content

Usage Guidelines

When using AI analysis features:

• Content is sent to OpenAI for processing
• Processing is temporary and content is deleted per OpenAI's retention policy
• Analysis is provided "as-is" without accuracy guarantees
• You should not rely solely on AI analysis for critical decisions

Fair Use

AI analysis is subject to fair use limits:

• Free users: Limited to 5 analyses per week
• Linkery Plus subscribers: Unlimited usage
• We reserve the right to implement reasonable usage limits to ensure service quality

7. Prohibited Uses

You agree not to use Linkery to:

• Save links to illegal, harmful, or infringing content
• Attempt to circumvent usage limits or security measures
• Upload malware, viruses, or malicious code
• Harass, abuse, or harm others
• Violate any applicable laws or regulations
• Interfere with the proper functioning of the Service
• Use automated tools to access the Service excessively
• Impersonate others or misrepresent your identity

8. Intellectual Property

Our Rights

Linkery and all related technology, including:

• Source code, algorithms, and software
• User interface design and visual elements
• Trademarks, logos, and branding
• Documentation and content

Are owned by us or our licensors and protected by intellectual property laws.

Your Rights

You retain all rights to Your Content. We do not claim ownership of links, notes, or other content you save in Linkery.

DMCA Compliance

We respect intellectual property rights. If you believe content in Linkery infringes your copyright, contact us at linkery@msbkv.dev with:

• Description of the copyrighted work
• Location of the infringing material
• Your contact information
• Good faith belief statement
• Accuracy statement under penalty of perjury
• Electronic signature

9. Privacy and Data Protection

Your privacy is important to us. Our data practices are governed by our Privacy Policy, which is incorporated into these Terms by reference. Key points:

10. Disclaimers and Limitations

Service Availability

Linkery is provided "as-is" and "as-available." We do not guarantee:

• Uninterrupted or error-free service
• Compatibility with all devices or iOS versions
• Accuracy of AI analysis results
• Permanent availability of any features

Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the amount you paid for the Service in the past 12 months
• We are not liable for indirect, incidental, special, or consequential damages
• We are not responsible for data loss, business interruption, or lost profits
• Some jurisdictions do not allow liability limitations, so these may not apply to you

Third-Party Services

We integrate with third-party services (OpenAI, RevenueCat, Apple) and are not responsible for:

• Their availability or performance
• Changes to their terms or pricing
• Any issues arising from their services
• Data handling by these services (governed by their privacy policies)

11. Termination

Your Right to Terminate

You may stop using Linkery at any time by:

• Deleting the app from your device
• Cancelling your subscription through iOS Settings
• Contacting us to delete your account data

Our Right to Terminate

We may suspend or terminate your access if you:

• Violate these Terms or our policies
• Use the Service illegally or harmfully
• Fail to pay subscription fees
• Engage in behavior that harms other users or our Service

Effect of Termination

Upon termination:

• Your license to use Linkery ends immediately
• Your local data remains on your device
• Your iCloud data remains under your Apple ID control
• Subscription benefits end immediately (no refunds for unused time)

12. Updates and Changes

App Updates

We may release updates that:

• Add new features or functionality
• Fix bugs or security issues
• Improve performance
• Modify existing features

Updates may be automatic through the App Store or require manual installation.

Terms Updates

We may modify these Terms by:

• Posting updated Terms in the app
• Updating the "Last updated" date
• Providing notice through app updates or notifications
• For significant changes, requesting your acceptance

Continued use after changes constitutes acceptance of the new Terms.

13. Geographic Restrictions

Linkery is available worldwide, but:

• Some features may not be available in all regions
• AI analysis features depend on OpenAI service availability
• Subscription pricing may vary by region
• Local laws may affect available features

14. Dispute Resolution

Governing Law

These Terms are governed by the laws of Kazakhstan, without regard to conflict of law principles.

Dispute Resolution Process

Before pursuing legal action, we encourage you to:

2. Allow 30 days for a good faith resolution attempt
3. Consider mediation if direct resolution fails

Arbitration

For disputes that cannot be resolved directly:

• Individual disputes may be subject to binding arbitration
• Class actions are not permitted
• Arbitration will be conducted in English
• Small claims court disputes are excluded from arbitration

15. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the complete agreement between you and us regarding Linkery.

Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other provision.

Assignment

You may not assign your rights under these Terms. We may assign our rights and obligations to any party.

16. Age Restrictions

• The minimum age required by local law in your jurisdiction

If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

You agree to comply with all applicable export control laws and regulations. You may not use Linkery in any country or region where its use would violate such laws.
